Six short questions, then your details. Under a minute, and they are the questions that decide who you actually need, and who is likely responsible.

Question 1What are you dealing with?
Question 2What kind of building is it?

In Miami-Dade this changes who hires whom. In a condo or townhouse the association may be responsible for part of the building and you for the rest, so the first answer we give depends on this one.

Question 3Where do you think the water came from?

If it came from a neighboring unit or from the building itself, say so. It usually decides who pays, and a written finding about the source is worth having before anything is removed.

Question 4Is anything still wet?

EPA guidance is to dry wet materials within 24 to 48 hours. Inside that window this is usually a drying job. Past it, it may be a mold job.

Question 5What is your connection to the property?
Question 6How soon do you want someone on it?
You, and the property this is about

Who should we ask for?

How can we reach you?

We call to confirm the details before anyone is sent out.

Where is the property?

The contractor match is by property, not by person, so the street line matters.

Deciding

Aventura paperwork before the containment goes up

Put the paperwork in order before a saw comes in. The board's prior written consent is required for reconstruction on a unit, and it can be conditioned on the method, the contractor's qualifications and the contract. Permits for the rebuild come from the City of Aventura, folio code 28. And the claim stays yours: on a residential policy issued on or after January 1, 2023, Florida law makes any attempt to assign post-loss benefits void, so nobody here asks you to hand it over. A remediator who wants to go well past the written protocol should explain why in writing.

  1. What your own fungi limit is

Read the declarations page. Citizens' HO-6 form sets $10,000 for fungi; your insurer's figure may be different.

  2. What the board requires of the contractor

Insurance certificates, working hours and elevator bookings often come attached to the consent. Ask first.

  3. Who holds the claim

You do. A post-loss benefit under a 2023 or later residential policy cannot be assigned.

An attempt to assign post-loss property insurance benefits under such a policy is void, invalid, and unenforceable.'

What mold remediation involves in Aventura

Local Context

Removing mold from an Aventura tower unit, with the board involved

Aventura removals happen in towers. 86.9 percent of the city's housing units are in buildings of 20 or more, the highest share of any town we cover, and 63.6 percent of occupied units are owner occupied, so the person paying for the removal is usually the unit owner, working under a board's rules. Before the containment goes up, two numbers are worth knowing. Citizens' own HO-6 condo unit owners form lists a $10,000 limit for fungi, wet or dry rot and bacteria, and a $2,000 loss assessment limit. Your policy may differ, so read the declarations for yours.

Next Step

Has the Aventura board been told?

Tell us whether the association knows, what the protocol says has to come out, and whether the water is fixed.

Questions

Aventura policy and common-pipe questions

Will my Aventura condo policy pay for the whole removal?

We cannot tell you what a policy will pay. What we can tell you is where to look: the fungi, wet or dry rot and bacteria line on your declarations, which on Citizens' HO-6 form is $10,000, and whether the water that caused it is a covered cause at all. Ask your agent before the scope is signed.

The association says the water came from a common pipe. Who removes the mold?

Where association-insured property is damaged by an insurable event, Florida's condominium act has the association repair it as a common expense, while unit finishes and contents are generally the owner's side. Get the association's position in writing and hand it to whoever writes the protocol.

Next Step

Send the Aventura unit and the protocol

A person reads it and writes back with the order of work, board and policy included. Nobody asks you to sign anything about your insurance.
