City of Miami or county, board or owner: settle it before removal
In a condo, Florida's condominium act says a unit owner may undertake reconstruction on the unit only with the board's prior written consent, and the board may set conditions on the repair method, the contractor's qualifications and the contract. Ask for those conditions in writing first, since insurance certificates, working hours and elevator bookings all flow from them. Then check the permit route. The 2026 small-project permit exemption does not reach units in multi-family buildings at all, so a tower unit's rebuild should be priced on the assumption that a permit is needed.
Which folio code the property carries
01 means the City of Miami's building department; 30 means Miami-Dade County's. A contractor who files in the wrong office costs you days in an opened-up unit.
What the board has asked for
The board's written consent can come with conditions on method, contractor and contract. Get them before a scope is priced, not after.
Whether the protocol came from someone else
The remediator should be working to a separate licensed assessor's written scope, not to one it wrote itself. Florida bars one company doing both on the same structure within 12 months.

The Miami-Dade Property Appraiser's folio chart gives each municipality a two-digit code as the first two digits of the folio: 01 Miami, 02 Miami Beach, 03 Coral Gables, 04 Hialeah, 06 North Miami, 08 Opa-locka, 10 Homestead, 24 Key Biscayne, 25 Sweetwater, 28 Aventura, 32 Miami Lakes, 33 Palmetto Bay, 34 Miami Gardens, 35 Doral and 36 Cutler Bay. 'Code 30 indicates properties in Miami-Dade County not within the municipality, otherwise referred to as unincorporated.' Kendall does not appear on the list.

The City of Miami has 223,826 housing units in the ACS 2020 to 2024 estimates. 48.8 percent are in buildings of 20 or more units and 22.4 percent are single-family detached. 69.2 percent of occupied units are renter occupied. 7.8 percent of units were built in 1939 or earlier and 50.8 percent before 1980.

Section 718.111(11)(g)1: 'All reconstruction work after a property loss must be undertaken by the association except as otherwise authorized in this section. A unit owner may undertake reconstruction work on portions of the unit with the prior written consent of the board of administration.' The board may condition consent on 'the approval of the repair methods, the qualifications of the proposed contractor, or the contract', and 'A unit owner must obtain all required governmental permits and approvals before commencing reconstruction.'

Miami-Dade County's permit exemptions page says that beginning July 1, 2026, Florida House Bill 803 lets certain work valued under $7,500 on single-family homes, duplexes and townhouses proceed without a building permit. 'Units in multi-family buildings do not qualify', properties partly or entirely within a flood hazard area are not eligible, electrical, plumbing, structural, mechanical and gas work always requires a permit, and a project cannot be split into phases to avoid permitting.

Section 468.8419(1)(d) says a person may not 'perform or offer to perform any mold remediation to a structure on which the mold assessor or the mold assessor's company provided a mold assessment within the last 12 months.' Section 468.8419(2)(d) is the mirror rule, barring a remediator from assessing a structure it remediated within the last 12 months. Under 468.8419(3) a violation is a second degree misdemeanor the first time, a first degree misdemeanor the second time and a third degree felony after that.

The removal is the part of the job that runs into other people's rules. A Miami mailing address covers more than the City of Miami, and the Property Appraiser's folio chart gives the city code 01 while unincorporated land carries 30, so the rebuild after a removal can belong to two different building departments on neighboring blocks. Nearly half the city's housing, 48.8 percent, is in buildings of 20 or more units, which puts most removals inside a condominium or a rental tower where the board and the manager have a say before a saw comes in. Get both answers before the containment goes up.

Who arranges a removal in a rented City of Miami unit?
Normally the owner of the unit, because the walls are theirs, and in a condo the board's consent to reconstruction runs to the unit owner, not the tenant. What a tenant can do is send the landlord a dated written description with photographs, and keep a copy. If the owner wants a scope, a separate assessment provides one.
Does the whole Miami apartment have to be sealed off?
Rarely. Containment is built to the area the protocol marks, so an AC closet job can stay an AC closet job. In a tower, ask the manager where debris can be carried and whether the service elevator needs booking, because bagged material leaves through the building's common areas.
